Please read these Terms of Service carefully before using the RefinedClub website and store (the “Services”) operated by DDL Commerce LLC. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. Eligibility

You must be at least 18 years old to use the Services or make a purchase. By using the Services, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. Products & Pricing

We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice. All prices are displayed in U.S. dollars (USD) and are subject to change without notice. We reserve the right to correct any pricing errors and, in such cases, may cancel or adjust orders accordingly. Product images are for illustrative purposes only; actual products may vary slightly in color or appearance.

4. Orders & Payment

By placing an order, you represent that all information provided is accurate and complete. We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or that cannot be fulfilled. Payment must be made in full at the time of purchase. We accept major credit cards, debit cards, and other payment methods available at checkout. All transactions are processed securely through Shopify Payments and other authorized payment providers.

5. Shipping & Delivery

Orders are shipped within the United States only, unless otherwise stated. Delivery times are estimates and are not guaranteed. RefinedClub is not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our control. Risk of loss and title for items pass to you upon delivery to the carrier. 6. Returns, Exchanges & Refunds

Our return, exchange, and refund policy is described in our separate Returns Policy, which is incorporated into these Terms by reference. By purchasing from RefinedClub, you agree to the conditions set out in that policy.

7. Intellectual Property

All content on the Services — including text, images, logos, graphics, and software — is the property of DDL Commerce LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

8. User Conduct

You agree not to:

•       Use the Services for any unlawful purpose or in violation of any applicable regulations.

•       Attempt to gain unauthorized access to any part of the Services or related systems.

•       Transmit any harmful, offensive, or disruptive content through the Services.

•       Use automated tools (bots, scrapers, etc.) to access or collect data from the Services without permission.

•       Impersonate any person or entity or misrepresent your affiliation with any person or entity.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, DDL Commerce LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. Our total liability to you for any claim shall not exceed the total amount paid by you to RefinedClub in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless DDL Commerce LLC, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of another party.

The Services may contain links to third-party websites or services. These links are provided for convenience only and do not imply endorsement. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your interactions with third-party sites are solely between you and those parties.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in our Privacy Policy.

14. Modifications to the Services or Terms

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time with or without notice. We may also update these Terms at any time. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Albuquerque, New Mexico. You consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and DDL Commerce LLC regarding your use of the Services and supersede any prior agreements.
